Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of the SaveState cloud backup service ("Service") operated by SaveState ("we", "us", "our"), a personal/sole proprietorship project based in Denmark.

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

2. Description of Service

SaveState provides automated cloud backup services for servers, databases, and infrastructure. The Service includes:

• Automated scheduled backups via the SaveState desktop agent
• Cloud storage of encrypted backup files
• A web-based dashboard for managing backups and account settings

3. Accounts and Registration

Accounts are created through the Stripe checkout process. By subscribing, you agree to provide accurate information and maintain the security of your account credentials.

All plans include a 14-day free trial. A valid payment method is required to start the trial. You will not be charged until the trial period ends. You may cancel at any time during the trial without being charged.

You are responsible for all activity that occurs under your account.

4. Acceptable Use

You agree to use the Service only for lawful purposes. You may not:

• Store, upload, or back up any illegal, unlawful, or prohibited content
• Use the Service to distribute malware, viruses, or malicious code
• Attempt to reverse-engineer, decompile, or disassemble any part of the Service
• Attempt to gain unauthorized access to our systems, infrastructure, or other users' data
• Abuse, overload, or interfere with the Service's operation
• Use the Service in any manner that could damage, disable, or impair our infrastructure
• Resell, sublicense, or redistribute the Service without our express written consent

5. Zero-Knowledge Encryption

All backup data is encrypted on your device using AES-256-GCM zero-knowledge encryption before it is uploaded to our servers. This means:

• We cannot access, read, or decrypt your backup data
• We cannot recover your data if you lose access to your account or encryption keys
• You are solely responsible for maintaining access to your account credentials

Important: If you lose your login credentials, your encrypted data cannot be recovered by SaveState or any third party. We strongly recommend keeping secure records of your account information.

6. Payment and Billing

All payments are processed by Stripe. By subscribing, you authorize Stripe to charge your payment method on a recurring basis according to your selected plan (monthly or yearly).

Prices are listed in Danish Krone (DKK) and are subject to change with reasonable notice.

7. Refund Policy

Refund requests are handled on a case-by-case basis at our sole discretion. The 14-day free trial is designed as a try-before-you-buy period, allowing you to evaluate the Service before any charges are incurred.

8. Termination

You may cancel your subscription at any time through the Service dashboard or by contacting support. Upon cancellation, your account and all associated data (including encrypted backups) will be deleted.

We reserve the right to suspend or terminate any account and delete all associated data, without prior notice, in the following cases:

• Storage of illegal or prohibited content
• Abuse of the Service or its infrastructure
• Defamation of the business, its operators, or its services
• Violation of these Terms
• Non-payment of subscription fees

9. Limitation of Liability

The Service is provided on an "as-is" and "as-available" basis without warranties of any kind, whether express, implied, or statutory.

SaveState is not liable for any data loss, corruption, or inability to access backups. While we make reasonable efforts to ensure the reliability of the Service, you acknowledge that:

• No backup system is infallible
• You should maintain your own local copies of critical data
• We are not responsible for data loss caused by third-party service providers, hardware failures, or events beyond our control

To the maximum extent permitted by applicable law, SaveState and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of or inability to use the Service.

10. Indemnification

You agree to indemnify, defend, and hold harmless SaveState and its operators from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service or violation of these Terms.

11. Service Availability

We strive to maintain high availability of the Service, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

12. Changes to These Terms

We reserve the right to update or modify these Terms at any time. When changes are made, we will update the "Last updated" date at the top of this page. Continued use of the Service after any changes constitutes your acceptance of the revised Terms.

We encourage you to review these Terms periodically.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of Denmark, including the General Data Protection Regulation (GDPR). Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the Danish courts.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
